Hi, wow am I in a fix...a big one...I had an investment property and it didn't sell, I needed some cash...so I transferred the deed to a very dear friend to get a mortgage and split the money with him. Well, you guessed it...I know I will not get my property back, but, can I file a lien on it for the work, supplies and materials I invested to fix it up?

Better Idea would of been to stay on title and have him take a 1st or 2nd mortgage against the property. Or tranfer title to land trust and share a 50 - 50% ownership with him

you should have drawn up an agreement stating the equity ownership split, or like the above person said, remain on title...quit claim 50% equity to him... that's wild.

Yes, I agree it was stupid, but I thought I knew this person over 2 years...I really feel bad enough, I have lost trust...really more important than the property...please post only replies that you feel may be helpful in resolving this problem. Thanks...but I have beat myself up enough for all of us.
Have you got any evidence, other than your own memory, that could be used in court to back up your claim, and prove it to the Judge (or jury) ?
If so, suggest you get to a lawyer and get a suit going immediately to partition the property and get your 1/2...and simultandously record a Lis Pendens in deed records so other guy can't sell it out from under you.

Why not? Just file lien. See an atty - he'll show you how to file and maybe how to sue.
use your emails and file immediately against the property.... when it goes to court you should be able to show fraud and intent .... he might lose all interest and equity if you have enough in the emails..... good luck move quickly....
