Who Is Liable For Water Damage Repairs.

One of my tenants turned off the heat to her unit while away on vacation to save money. The pipes burst and I am looking at some substantial repairs. She did not get renter's insurance. The lease "strongly suggests" that renters get insurance, and that renters "assume all liability for damages that can be insured" with renter's insurance.

I have spoken with my insurance agent and she said that if I file a claim, they will pay it, but will then pursue the tenant in court.

Depending on the cost of the repairs, I may be better off not filing a claim with my insurance company.

I would appreciate any advice on this issue.
