We Need To Fire Our Contractor. What Should We Do?

We have a contractor who is rehabing and adding another 650 sf to the small 2X1 bungalow we bought in March. He was supposed to finish the project by July, but he has yet finished it. He kept on promising us to finish in two weeks over and over and again. We got pretty tired of hearing the same excuses. When it is not covenient for him, he does not even call us back.

We have a Fannie Mae rebab loan for this project, and he only got two draw totalling $10,000. The total project cost is $28000. We are seruously considering about firing this guy, but we are wondering how we can do this without hurting ourselves legally and financially.

Any advice will be welcomed. Thanks.

    1) is contractor licensed? If yes, then you have recourse with the State such as filing a Non-Performance action so that you can "legally" replace him with someone else.
    2) If not licensed and depending on what your contract says, you must give him notice to perform before you replace him also advise him that if he fails to perform, you will pay him for the work completed to date and terminate the contract. You need to clear this with the lender since they control the payments.

    If I remember correctly GA only licenses specific trades.Do you have a contract,stating a completion date?

    Start documenting the dates He or employees or subs are there and what they do on a printed calendar.
    Log phone calls and or messages left.

    Hi Smiley,

    If you pulled a building / renovation permit then contact the buiding department and they can advise you.

    If he is licensed, then you should contact the licensing board.

    Also to cover your assets.....contact suppliers and others to make sure that all bills were paid and get waivers from them as well.
