Using Summer Home As Primary Residence
I am selling my summer home after 26 years. I could certainly make a case that I lived there for two of the last five so I can avoid capital gains taxes. I will most certainly live in my primary residence for at least two years after the sale thus reestablishing it as my primary residence. Is this a wise or legal tactic?
When you have more than one home, your primary residence is where you spent most of your time during the year. Seasonal occupancy over five years could certainly aggregate to more than 24 months, but you would fail on the most of your time test.
Sorry, but from the information you have given, it sounds like this summer home is just a second home whose sale will be fully taxable.
