Using A Camera When Viewing A Property?

I got a call from a broker about a potential local property. I went to see it, and there was from what I could tell some significant damage.

My question: The tenant still lives in the property, am I allowed to take pictures/video of the property to show investors/ contractors, or to keep in files? I got a great digital video camera, that also takes stills, and I really want to take video of the basement, the chimney, pretty much the whole house. This way, I know exactly what I'm dealing with, without having to visit the place a million times.

Does it matter that the tenant still lives there? Should I get a waiver of some sort?

    Although at times agentsdo not like it, there is no law in the state of Iowa that prevents you from taking pictures. I have never taken pictures with tenants there though so no one except the agent knows.

    Any idea about NY?

    The broker didn't know, actually, the broker didn't really care. He just said "Act as if you've done it before."

    I'd call my lawyer and ask, but I'm sure it'll cost me something if I do.

    It is much easier to receive forgiveness than to get permission. I say let the film roll! You'll never have a better chance to document the most obvious problems. Just act like you already have permission, and be as professional as possible.

    I often take pictures of the interior to support my position regarding the physical condition of the property. Albeit never with a tenant occupying the property. I don't think they will object.

    I tried viideo a couple times, but found it to be too slow and not as effecitve as specific photos.

    i take pictures of every property i look at. when i show up i have the camera on and in my hand... they never ask questions about it.
