Title Trouble After The Sale

I purchased a sfh at auction on March 8, 2003. We were to close on the purchase a few days prior to the actual closing date, but the realtor that did the auction had a problem getting the wife to sign the deed.

So they were going to get the Master Commissioner to sign in her place if she refused to sign. So the woman signed the deed and the sale went through.

Now five months later, I can not refi the house because the title is not clear. The title company has been working hard to get the matter cleared, but it has been over three weeks now. Meanwhile, I have lost the good rates on refi's. I am wondering if I should sue the title company for improper business efforts. I have been paying on a house that I technically don't own.

I paid them to make sure the title is clear, it is costing me money if the rates go up again. Plus I was to pay off a loan with some of the cash that was to be pulled out of the deal. Would these people sue me if the situation was reversed???[ Edited by Vern on Date 08/19/2003 ]

    Your details are a little unclear but if you paid for title insurance at the time of sale, that's exactly what it's for...gettting clear title. Consult with your attorney!

    Hello Gold,

    Somewhere between the closing and now the signed deed or title paper work has been mis-filed or something. The title company is suppose to ensure the title is clear and filed. Somehow, a linkage is missing and I am getting the short end of the stick. It could be a honest mistake that the paper work has been misplaced. Or someone could have given the deal some crooked handy work.

    Maybe seeing a real estate lawyer may be the best after all. Thanks
