Tenant Split

Need some advice. I just rented a unit in April with a year lease. I just received a letter from the tenant in lieu of July rent with the key enclosed announcing they are departing - included in the explanation was also permission to use their deposit for July rent. My question is, do I go after this tenant ? (the lease officially expires in April of 07)??? If so, what are my chances of recouping any funds for lost revenue and how do I go about doing that? I am mainly interested in real world practice/experience. The property is in North Carolina. Looking for some direction - Thanks in advance.

    I kind of figured that - I guess whats troubling about that is that a tenant can break the lease and suffer no consequences.

    Can you file in small claims court against an ex-tenant if you live in a State different from where the property is located? Can this be done over the web or phone?

    If their credit score is below 600 forget it an move on because a judgement is only a drop in the bucket. If their score is good I agree with Wiz.

    Filing in small claims remotely is dependant on the city/state. California is very high tech and provides all the forms online. NY -- forget it. You have to go to the courthouse, pick up the forms and return them. And, then you have to show up for the trial.$$$$$
