Tenant Left Property Without Notice

I have a property in charlotte NC, the tenant has not responded to any of my calls, notice of deliquency, etc... I passed by the property to check if the tennat had moved out, he is someone from out of town and there could be a possibility he went back to his previous town. The house is vacant with only a couple of personal items. I was wondering if I can start a personal property eviction in order to get the items out of the house and put the house back in the market.

Please advise!!!!

    Did you have an abandonment clause in your lease agreement that said that you would assume control of the property if evidence of abandonment?

    I believe I do have an abandonment clause...if this is the case then would I still have to file the summons at the court?

    Just looking now. Spoke to process serving company down here who told me entire court system is 4-5 months behind because of foreclosures. Meanwhile, landlords who are trying to hang tough, are suffering the consequences.
