Tenant Does In Home Daycare
I am looking for information that may help a client of ours. The husband is a Pinellas County Florida Police Officer and the wife babysits for 2 children, one of which is a family member and the other belongs to her husbands former partner. Because she is above board she does carry licensing for in home daycare. We have been unable to find her a rental because prospective landlords say she is running a business and they may be liable. She naturally has the ability to carry her own liability insurance.
This family is about to be rendered homeless as their current landlord has asked them to leave because of the childcare.
Any words of advice?
Thank You!

Interesting subject and question. I would think 2 kids would be ok. But she probably has a few of her own , which presents the problem. Most landlords with any sense will deny the daycare if they want to keep their property.
Maybe she could offer more rent $$ and not mention daycare in the lease or discussion. But the only thing i see is offering more $$, hopefully others may have a better idea. Good luck.
is it prohibited by the lease?
By local, county or state law?
Otherwise sounds o.k.
Our residential lease prohibits any sort of business on the property.[ Edited by patty on Date 05/07/2010 ]
Leases, like contracts to purchase, can be modified by agreement, the stroke of a pen and initials.

this is a liabilty question. i dont think extra rent money is worth the additional liabilty issues.
You say “Because she is above board she does carry licensing for in home daycare.â€
So how did she get a license to run a Day Car Center?
If you run any kind of business in your home, including a Day Care Center here in Las Vegas, the landlord MUST sign off that they are aware of and approve of the business in that rental home.
Don’t you have similar laws?
