Question On Sub2
arkansas is a title holding state, (for instance, they hold the title to your car until the lein is paid off) I dont know how they do the deed to property but after talking to a couple of homeowners they said they have a copy of the deed but the original is at the courthouse,
my question is this, will this affect sub2 or am I making this harder than it really is.
Somebody is confused. The courthouse records a copy of the deed or takes a picture and puts it on file. They assign it a volume and page number and make it easier to locate the copy if it needs to be examined. This really has nothing to do with sub2 except the mortgage or deed of trust is also recorded at the courthouse in the same way. The original deed is sent back to the owner or buyer and the original mortgage or deed of trust is sent back to the lender. Your car title too is held by the bank or credit union until paid off and not by the state or county. It is easy to make this stuff hard if you get it confused.. In a deed of trust state the title to the property is actually held in trust by the trustee untill the loan is paid in full and is released. If there is a default, the trustee will send out notices and foreclose on the property(forced sale at the courthouse). In a mortgage state the lender will have to go to court and get a court order to have the sheriff sale the property.
