My Personal Home Sub-to

G'morning,
I have a dilema....my ex husband has gotten behind on the mortgage on our 20 acre 3br home.
Long story, but as I personally didnt recieve the paperwork that the bank sent, calling the arrears or loan due in full ( still not sure exactly whats going on yet >smile )
because of this....can I delay the foreclosure process?
Neither of us can pay it out, the only way I can think of to save my house is to sell it sub-to...I would want the 1st option to buy back in 24 months though...and make it well worth the sub-to investors help,($) as I will qualify for the financing myself by then.
Im in a sadly IRONIC rut as I am yet to close my 1st deal to get the ca$h to help my own self!, can anybody give me some insight here please? confused
this is extremely distressing. downer

    First, I would get the ex out of the picture. If you were to save the house he may be titled to half. To do this just do a quick claim. Your options from here will depend on how much is owed in reinstatement. I know that I(as an investor) would not pay reinstatement fees and sit on it for a year. Try to work with the bank, ask for a forbearance, negotiate to pay something. If you cannot afford to pay, find a tenant. You may find it beneficial if you hanven't already missed the court hearings, go to them and explain you are willing to pay something. This may postpone the foreclosure sale. Good luck.

    hey, thanks for the response....however..getting the ex off the morgtgage wont happen, he wants me off it but thats irrelevent right now .....
    I have contacted the bank3 times in this past week and they tell me the correct person is not available to speak right now and they will call me back.
    I dont wait, I call again, but get the same answer...
    meanwhile, the clock is ticking I haven't recieved ANY paperwork of "PAYUP OR ELSE" from them myself, and by not responding to what i DIDNT recieve, they say I have also ignored their request for payment.
    The payments in arrears are only a total of 600Aussie dollars, but not knowing I had them due is another matter when I need to do a please explain to the bank, who now wont refinance because of this.
    Surely the morons wouldnt think of foreclosing on it for that amount, it'd be more than the effort is worth, although ex tells me the 'bluff letters' look pretty real.
    I thanked him for keeping me informed.....some people...sheeesh

    ( and the Ex, who says I have no credibility anyway *rolls eyes*)... get the better of me .
    After all the sweat I put into this place over the years, it's time to really think outside the box here for my own good.
    So I've devised a plan.
    Please ask me and I'll send you what I came up with so we can fine tune it s'more.
