State Rules
In the state of PA. are there any particular rules that apply to a sale when your intention is to wholesale the property.? Is it required to disclose that to the seller, or do you just add/ note that the property is assignable on the contract? I have heard that this is a good way to build up a cash flow when you really don't have the capital or good credit to close a deal. what do you suggest? :-?
I sell real estate in PA and I don't know of any regulations that require your telling the seller that you intend to wholesale a property. If you have an assign clause in your contract that you intend to take advantage of, I would advise you to make sure whomever you assign to this contract has seen and signed the seller disclosures that you should also have signed. (Seller disclosures are required here in PA). If a buyer purchases a home in this state and has never signed these disclosures it could mean legal problems for the seller and you in this case if there is a problem that was not disclosed to the buyer.
