SS Vs BK
I have a h/o who has been told by a BK atty here in FL that she is better off filing BK and walking away clean than doing a SS and winding up with a 1099 or deficiency judgment. She does not want the house, she just wants to walk away. Can a h/o file a Ch 7 BK to avoid the foreclosure AND any subsequent def judgment? If yes, then why would a SS be better than a BK? yes there would be a BK on the CR but eventually that will go away, the judgment remains until paid...
