Smoke From Adjacent Condo
I will be moving out and renting a condo I currently live in. I have new neighbors who occassionally smoke and the smoke can be smelled in my property.
I had a company come out and look at the problem. They say it is likely positive air pressure. When the neigbors smoke it goes into the vents or any openings in the walls. The smoke then penetrates any openings in my unit.
I talked to the neighbors and they said since their health is deteriorating they are trying to quit smoking. I think there is some truth to this since I don't notice the odor as much as I used to, but I also spent time and money sealing my unit as much as possible.
I can approach my HOA board and ask that they institute a regulation with a fine. This seems to be a drawn out process and I don't know if I can get the board to pass it cause some of them don't feel comfortable telling people what they can and can't do in their own unit.
I talked to the association and they said that it's not their problem.(I think they just don't want to deal with the problem. Since the smoke is somehow going through the walls and ventilation system...can I go after the association? Keep in mind that each unit has it's own ventilatioin system. How much of a headache is this going to be?
I suppose if the smoke affects my future tenants, they will be able to break the lease, right?
FYI, I live in Los Angeles County, California and the condo complex was build in 1985.
What should I do considering I want to rent out my unit and not have any problems related to the smoke?
