Authorization To Release, Who Signs
Looking for answers to who has the authority to sign the Authorization to Release form for Short Sales that goes to the bank.
This is the situation - husband and wife are split up (separate houses), but not divorced or nor have they filed for separation yet. The husband is the one named on the deed AND the mortgage.
Who has to sign the paperwork? Can the wife sign without the husbands consent? I am guessing no, but just want clarification. The state is New York.
I would ask a NT person about marital right, and if she has to side. That would be a little oversight that could cause a lot of grief.
