Seller Breach Of Contract
I have signed a Real Estate Purchase Contract under great duress due to an impending divorce and now I have reconsidered selling the home, can I be forced to honor the deal. My husband is not on title but he has contributed community assets to the home.
You might be especially if you received a deposit and sign a contract,the buyer may push to buy but you can always ask to get out of the contract and return all deposits to the buyer, be be warned his realtor may sue for their comission about 3% of a sale.. as to your husband if he is not on title he has no say so what soever, legally speaky...Abe P.
My agent secured a buyer who is an investor. The contact is written to state that I will pay the investor to find a buyer. I am suppose to pay the investor $50,000. They put no earnest money down. On Sunday and Monday I called the agent and told her I had decided to rescind the agreement. She faxed the agreement this morning to the Title company and submitted the offer anyway.
As for my husband, orginially when we went to close on the house he did not qualify and therefore had to sign a disclaimer deed to the property. However, we have used funds from his 401K to pay on the mortgage. He is claiming that he has a vaild interest in the property and wants to file an injunction.
The way I see it, the only one who is entitled to damages is the real estate agent.
