I agree, if you are going to nick at it, you may just make things worse. Get rid of the problem and cut your losses, quickly. You will easily spend that 6% on lawyers fees should the spouse disagree with that move. its probably not worth the risk.

I think it fair. Say the property is worth 100k, you wish to buy them out, if you used an agent it would cost you 6k leaving 94k then split that amount equal 47k each. Why not offer the partner 47k and be done with it. You are taking a chance that could net you more money or less money by keeping the property. Chances are the one partner that wants to be bought out never really wanted anything to do with REI in the first place. It's the law and you just got to roll with it.
