It sounds like wording from a HELOC Deed of Trust? Maybe an Open-end Deed of Trust? Anyway, you really need to go through the entire document to get the proper context, because there may be phrases in there like "Until the occurrence of and Event of Default, Grantor may (1) remain in possession and control of the Property; (2) use, operate or manage the Property; and (3) collect the Rents from the Property." Etc.
Look to see if there is a form number at the bottom of the page. Many lenders use national (standard) forms. Regardless, it is a good exercise to read through these documents end-to-end, IMO, just like any other contract.
I was wondering if they could do more than pursuing him for the $$ and making it more than a civil or contractual issues?
I always see a statement that I will rectify any inadvertent errors the escrow agent makes in the huge pile of papers one signs at a closing...
