Quit Claim Deed
ok here we go, my brother has a quit claim deed that my stepfather gave him five years ago, he never filed it.he didn't want to pay the taxes, cause my mom was on a homested tax for the land. My stepfather pasted away and it went into probate he still never filed it and everything went into my mothers name,but the day before it went into her name she pasted away and her stuff went into probate well it's been a year now and i am selling the land,he is not happy with the offer and now wants to claim his deed. It would all depend on if your step-father purchased the property alone and your mother was not on the deed before your step-father died.
Check with a RE attorney, but I would think your brother is the owner since he already holds the deed.
Even though you do not file the deed you can still be considered the legal owner in Texas, as long as you either occupy the property or file your deed before someone else files a deed on the same property if it is vacant.
