Quit-Claim deed
Hi-- I just found this site and am hoping that someone can help me out.
My 75 yo mother's house is in need of some major repairs which she cannot afford. My niece and her husband want the house so are proposing that she sign a quit-claim deed (since they would not be able to get a mortgage with the property like it is) and then they will turn around and get a mortgage in their name in a few months. In the mean time, my mom will move into an apartment and they will pay her rent.
This proposal sounds good, but I am concerned as my mother needs this cash to pay off some major bills. Dealing with family can be a very touchy situation (what if they can't get a mortgage and can't pay what she wants for the house? comes to mind first off).
I was wondering if anyone had some things they thought I should be aware of? or suggestions as to how successful a transaction like this could be.
