Summary Ejectment In North Carolina
Was hoping to get some advice. I want to be sure to do this right. I have a tenant that is always late with rent. I inherited her from the previous landlord when I bought the place. She has been late 3 out of the last 4 months. I got last months rent on Sept 30 with a promise to pay Oct rent by the 5th. Needless to say she has not paid it. Today I called her inquiring about the status of her rent and she has not responded. I also went to talk to her personally at the apartment and she ignored the bell and my knocking. I know she and her family were home as her vehicle was in the driveway and I say people moving behind the window shades. I think she is now avoiding me.....I am getting tired of chasing her for the rent and am thinking of proceeding with evicting her. Does any one have any recommendations? suggestions? Any experience anyone has they would like to share would be appreciated. I was also wondering how long it takes in NC to evict someone. Thanks!

Give them a 3-day or 5-day (whatever NC requires) asap. This will help expedite the process as you get an attorney. Post it on their door, send it in snail mail and send it via Certified Mail. Have all your documentation ready for your eviction attorney.
I wonder if your condo insurance knows about this problem? It does sound like a fire hazard and sounds like it needs to be resolved immediately. You even might want to get others involved in resolving asap.
Meanwhile I would secure the microwave with a hazard tape and put a temporary microwave into the unit with the clarity that it belongs to you. Make a call to your local fire dept or code office to ask about this situation; the wiring might be defective in condo.
Many states require you maintain any appliance that you furnish the tenant. In some areas, tenants bring their appliances with them and if for some reason we have an appliance in the unit that is typically supplied by the tenant we put in the lease something like "tenant can use the refrigerator as long as it is operable. At end of life of the appliance, tenant is responsible for replacing the appliance with their own personal appliance" -- something like that.

As the condo was marketed to you with a microwave, I will be providing a new microwave for your use, intending it to become part of the condo property.
Unfortunately the one over the stove will stay where it is, unusable until Equity Corp. contracts with the repair of the wiring. I will purchase a white microwave so as to coordinate with the other appliances in the kitchen. Of course the HOA and Equity will have express instructions to contact you with plenty of notice to make needed repairs.

Scott - sorry but it is the typical "it depends" answer. Are you buying in TX? Texas is a brick and mortor state so if you are financing the deal, you have to finance through an institution that has a physical building in TX. However, if you want to pay "cash" you can purchase through a no interest credit card -- but keep in mind that the they are typically on 0% for a period of time.
For most of my TX properties I did ARMs but I also did a 30-year loan with Wells Fargo in TX for a property that is buy and hold (i.e., not flip).
