Problem W/ Homeowner

I recently 'took control' of property which was headed for the auction block within a few days. I was unable to make any leeway with the bank to shortsale (not enough time) I had the homeowner transfer the property into a trust and I have the assignment of beneficial interest. Along w/ Power of Attorney among some other documents. We agreed that he would be out by Jan. 8th. No money is given to him until that point, and only if he goes by Jan. 8th. Well, I have a feeling he is sticking around, b/c he is still procrastinating on finding somewhere to go, and I am pretty sure he ain't leaving. I did sign a lease with him. What should I do to insure he will be gone on Jan. 8th??? Thanks.

    You have some legal recourse, but the most cost-effective measure would be to offer to pay him to move. In some cases I have had to pay the 1st, last and security deposit to get them moved.

    JM is right. You have to push. Find him a place, pay for the moving van.Pay First, last and security for a new place. Believe me it's worth it. One less thing on your plate you have to chew.
