    Are you saying it is illegal to ask if people know private money lenders? Are you serious? All private money is, is non-institutional hard money... what is illegal about that?

    All cjmazur is saying is to be careful since there are rules as to what you can legally do regarding advertising. Your original post was "Please help me find affordable/Trustworthy Private money."

    You may need to look at family and relatives for your start up investment funds. Right now, it will be difficult to convince small or large investors to give you funding.

    Your timing is very very bad in regards to getting investment money for this real estate market.

    But i believe your timing to enter as a buyer in this real estate market is excellent, (if you have your own funds of course).

    As long as you give her some kind of Purchase Agreement or Option, you can do it legally. Why not up the price and interest rate (on a wrap) to cover the payment? You can collect half the down payment as your fee.

    The worst would be, legal exposure from the deal going south.

    You mentioned giving her forms. and suggesting she see an atty. I would just send her to the atty. That way they are on the hook.
