Personal items in home

Hello,

I purchased a house at a Sheriff's sale. They told me that any personal items were not transferred in the sale. I would have to go through a legal procedure to obtain legal title.

I talked to a County Attorney and he said all I had to do was notice the owner by Certified Mail with a deadline. Remove the stuff, or it would be considered abandoned. The property is in Kansas.

Any thoughts on this?

Thanks in advance.

The attorney is correct, you can give them a deadline to remove it or else it is considered abandoned, but you should check with a RE attorney before doing so. If the owner of the items do not receive the letter, then they can complain or even start a lawsuit. As long as you can make sure the letter reaches them, then you should be fine. Consult a Real Estate Attorney though.

    Hello Tanya,

That's part of the problem. The old owner seems to be hiding from the law.

    Thanks for the info/help.
