Operating Agreement

I just read another post about how you need to be careful with your operating agreement. Which surprised me and scared me because I thought it was the aseist part of setting up my LLC. I just have one of those standard jobbies from Office Max and wrote in my name, my mothers and that we each own 50% . Did I miss something??

    Like any other legal doc (insurance policy, contract, deed, etc.) all the parties to it should read it before signing, to make sure it meets their purposes.

    I've nailed lots of insurance companies on coverage that some adjuster or other claimed didn't exist...because, like any other written contract, the language of the contract itself is what forms the agreement...and not what somebody's opinion might be!

    An LLC op agreement should clearly state who the manager is, what the rights of other unit holders are, etc.

    So I'd suggest you and your Mom both read your op agrmt and make sure you like what it says.
