New House-Old Tenant

I am purchasing a house, close May 1, 2005. The old owners tenant is still in the house even though he was told in mid-March that we would be closing May 1. What are my legal rights as the new owner to have him move out so I can move in. confused

    If there is a lease in place or it was not addressed in the contract, you have the right (obligation) to inherit the tennant.

    I bought one last year that had a tenant in it. But there was no lease and I wrote into the contract that I would receive a vacant property at closing, making it the sellers problem and not mine. There was communication early in the process, the existing tennant was already expecting to move and was in the process of moving. After the closing, I took the keys to my tennants and there were no problems.
