Need Help In Ohio Regarding IRS Liens
Got a house in Ohio thats going to sheriff sale soon, owner thinks no profit/equity possible because IRS has 2 liens against it -- one lien for not paying the federal withholding taxes that he took out of his employees paychecks and the other for not paying his federal taxes. This guy filed a ch 7 a year after IRS put the liens on his house, he tells me that the IRS lien for not paying HIS taxes goes away 3 years after filing his ch 7 and that the IRS lien for not paying his EMPLOYEES federal withholding taxes never goes away. Mortgage on his home in default for no pay to bank, thus the foreclosure/sheriff sale. Anybody out there know what IRS liens go away and which stay? 500 people will look at this post and only a very few will reply. Prove me wrong!

You can attempt to settle the IRS liens, as they are somewhat negotiable.
If you buy this property, you will be responsible to pay the liens to get a clear title.
I would suggest that anything this property owner tells you take with a grain of salt.

What county in Ohio are you talking about? I am in Stark and I can read the foreclosure complaints in this county. This document tells how the IRS is going to respond to the foreclosure action. In some cases, the IRS will just write off the lien, in others the IRS has a period after the auction date to decide if IRS has any further interest in the property. Suggest that you find and read the foreclosure complaint document to start with and then decide whether you want to contact the IRS office. Send me an e-mail if you desire.

Thanks, Longshot for your help. I am in Cuyahoga County, #18. I did go to the mortgage companies complaint/lawsuit and read the docket. I see where the court sent sent a sums(summons? summary?) to the United States C/O Attorney General, Dept of www.Justice.The docket really just says that the court received an answer from the United States of America. I`ll call a clerk at the courthouse on monday, 3/14/05 and have them read me the reply.
