I know everybody in CA wants to sue at the drop of a hat. It is of course going to be very costly, especially from out of state. The Texas Real Estate Commission is the governing board for real estate agents. If an agent has done something that is grossly neglegent, TREC will have something to say about it. You can threaten with going to TREC and if they still dont comply, then go to TREC first. Then get an attorney.
I would try, try and then try some more to resolve the issue. There is also mediation. This is the preferred way to handle disagreements these days. I guess the courts are trying to save space in the court room for the drug dealers and pediphiles instead of the real estate agents.
