Disclaimer Or Advetising?

I know that Darius, has been notified and even a couple of his posts deleted for advertising, so now I am wondering about his latest way.

$$$

Warmest Regards, Darius M. Barazandeh, Attorney at Law / M.B.A. NOTE: Any material found on this discussion forum or email with Mr. Barazandeh is for educational purposes only and does not create an attorney client relationship.

We are aware that you cannot advertise under your name, so what I am trying to figure out is, is he advertising or his advice is so bad he has to give a disclaimer?

    OH, there it is.

it must be that grey background.

    John,

I guess this is partly my fault, as I pm'ed him today that his "attorney at law" tag line not only could be viewed as an ad, but by putting that in, any postings that he makes could be viewed as legal advise since he is advertising himself as one.

Apparently, the ad thing either went over his head, or this is his way of trying to get one over on TCI. Personally, I think it's time for him to go.

    Raj,

I have never seen any attorney including Bill Brochick pull this one, it is a flat outright ad.

It is not your fault he apparently feels he is above the other posters here at TCI and the rules, how do we tell the other posters you cannot advertise albeit in a post or under you name when it is allowed to happen with a channel partner.

It is not tough enough controlling the blantant advertising and hustling posts, with out cutting him some slack.

I'm not familiar with this poster. However, an attorney should be able to figure out how to phrase posts on TCI so that it's clear:

    1. the attorney is responding generally to the inquiry, and is not giving legal advice
    2. there is no attorney-client relationship between the other poster and the attorney

without having to put at least some of that stuff in the signature line. RE licensees and any other licensed professionals have the same issue.

Why not tell him his signature line should read:

"Warmest Regards and for educational purposes only, Darius M. Barazandeh"

This just goes back to the discussion that the mods had awhile ago anyway.

The signature line is just another place that someone with the intent can post an advertisement, and other than that, it serves no real purpose. The problem would be solved if the signature line was simply removed as an option.

I was unsure what to do with his signature line myself. Yesterday I though about posting it here -- but after re-reading it decided not to.

I think it's advertizing, but then again it is his title..

What will we do if someone adds lawyer or RE-Investor or their name?

Even removing the sig line won't solve the overall problem.

I would like to get him to change the line if we can find a consistent way to enforce it for all.

    Ideas?

    Concerning Glennl's points...

One thought might be to prohibit any reference in any poster's signature to what they do, or their occupation, or their degrees or professional designations, etc., anything smacking of hustling (conveying the "been there, done that, oh, I'm so experienced" impression).

Currently, in the "My Info" section, there is no occupation category for Attorney. If "Attorney" were added as an occupation, then "attorney" could be deleted from Darius' signature (along with all of the other stuff).

Is there any harm allowing him to keep the following in his profile:

"NOTE: Any material found on this discussion forum or email with Mr. Barazandeh is for educational purposes only and does not create an attorney client relationship.

    Extra Info:
Darius M. Barazandeh is a licensed attorney in the state of Texas - Bar Card Number ID 24038756. He has real estate investment experience with tax liens and tax deeds, lease options, and mobile homes."

    Joel,
I would appreciate it if "Realtor" were not used as an occupation, but "RE Licensee" used instead. People are not licensed as "Realtor". They are licensed as Broker, Associate Broker or Agent. So I think "RE Licensee" would adequately cover the classes of license. "Realtor" signifies membership in an organization. It would be like saying your occupation is a Rotarian.
