I was going to purchase a rural property. I received the disclosures a couple of days prior to presenting an offer. When the realtor met met there I ask the seller, the seller's agent and "my" agent. I ask them about the findings that the property was in a " flood" zone. The owner (who is a builder) and both of the agents stated that that was an error and they could make it go away. In addition, I called a geologist and spoke with him regarding the well on the property that was putting out 10 gallons per minute a few years back but is now putting out 2 gallons per minute (and it is a vacation rental so how much less would it put out if it were lived in full time). Well, I called escrow 3 days after it opened to cancel it. I received a letter from the seller's agent stating that I was in breach of contract. On my counter offer I told my agent that I would remove the sell of my home as the contingencies. He wrote that all contingencies would be removed. Does that mean that I did not have a 17 day discovery period? If so, shouldn't that have been discussed? Where do I stand?
