if certain judgement liens were discharged under chapter 7 bankrupcty do they still have to get paid off if they decide to sell their home. will a title company make an exception to title even thought these liens were discharged...is there a certain amount of time one should wait after a chapter 7 to sell their property...
the specifics are....house worth 160k, 0we 135k they will clear about 15k after all expenses if it sold at that price...
liens that were discharged form bankrupcty were:
credit cards- $3,500
car loan- $6,200
medical bills- $150,000
the slate is clean except the mortgage on their house for 135k.
Did you do a title search?
are these misc liens on record at the county recorders office? or they just judgment liens that the creditors hold.
If they have attached the property then they would need to be paid as liens junior to the first and second.
