Landlord Lien Anyone?
Hey everyone,
Have any of you ever done a landlord's lien? We performed one on a tenant who was subsequently evicted. He said he was going to file for a "wrongful eviction" but that's a whole other story...
Property Manager says I have to put them up to auction by a certain date. He has suggested using Ebay. He's also saying the stuff has to sell to the highest bidder. I have all these items that are large - TV, Halogen lamp, Stereo with speakers etc. Not exactly convenient for Ebay. Anyone ever used an auction service you'd recommend?
I'd welcome anyone's input. Obvious questions are if I use Ebay do I start at a penny to make sure the items sell? What if not everything sells?
Also, when I file a judgment against this guy, do I credit the proceeds of the landlord's lien against the amount owed? That seems logical.
Or what if I really like the HDTV and wanted to keep it? Property Manager is saying I cannot keep anything. It must be bid at auction.
