L/O (accounting) Question For Apartment Complex.

I have a vacant apartment complex that i want to lease option for 1 yr with 10k down. (reason is to avoid short term capital gains). property needs extensive repairs, but buyer ready to start work asap. Is it necessary to take a MONTHLY lease pmts on this deal to make it a legal L/O, or can the option fee be suffice?. thanks
