Did he break the forbearance agreement?
Also, if Chase sent him a paya up greement that is current to today then I think you could possibly have his brother do a "subject to", pay up the agreement and then use the time to sell or for his brother to get his own mortgage.
Does he have the foreclosure document? And why did he wait so long. He must have been served to let him know the property was being foreclosed.
