Keeping Water Rights When Selling A Property

I know a developer in Vegas who holds onto the water rights and then leases them back. Vegas's population is booming, and the water supply is staying about the same. I thought this was good thinking.

Would it be possible to do this on a smaller scale? Every time you buy an SFR or an apartment, sell the water rights to a different company and then lease them back to the new owners indefinitly. Or sell them later on if you'd like.

Would this be possible and profitable on such a small scale?

    I've seen his post about Trump yesterday. He and Lucius are rear players here that can bring the unique problem in the way that demand the talent of thinking.

    hibby76, omega might have sarcastic approach but I never read his post that attacked anyone unless he got attacked. In contrary, you like to bite and that's not nice.

    In my opinion, you was out of line yesterday, provoking him to respond. His post was creative and vibrant alternative to many (less attractive) posts I've read here at the TCI, which is BTW an interesting and useful site.

    Weighing n from the left, frequently the young like to bite as it satisfies their pride and builds their ego.
    I haven't seen all of Hibby's posts but I have never seen one that was rude or attacked anyone unfairly. I generally find him bright and creative and generally very helpful.
    I find the idea of spinning of rights very interesting if it could be done, I don't quite see from this post how that would work out but thenI may not be looking outside the box far enough.
    I have sold property on the river before and thought that I should maintain the "fishing" rights, how about that?

    Hibby - you could do exactly as you are proposing, but for the fact that there are no water rights with the vast majority of single family homes.

    Those water rights were available to the developer when he bought the undeveloped land, but he doesn't transfer them to each home that he builds, they are usually deeded to the city or town where the development will get their water from. He does this because the town negotiates with the developer that if he wants his development to be able to tap the city water then the city wants the water rights that went with the raw land so they zero out their lose of existing water.

    So they just don't exist.

    Now if you go out an buy a property on acerage then there is a chance you might have some water rights, but the problem becomes if you sell them to someone, how to they actually access the water?

    In Colorado water rights are a world unto themselves. The city of Aurora out here just purchased the water rights from a large farming coop that went out of business so they could keep their taps flowing. We have special laws in place that allow a municipality to divert the water from the head waters and send it to their town if they buy the water rights to property that is 200 miles down stream from them.

    It is a complicated and specialized field.

    StockPro and Rehabinator, thanks for helping get this post back on topic.

    I do know that water laws vary from state to state. My Step-Father has a second home that's on an acre or two that has some water rights attached to it. Additionally, I've seen mentioned the water rights that are attached to a specific piece of property.

    I suppose I need to seek the council of people in my own state to find out how they're handled here. Thanks for your comments.

I am glad they deleted that post. there was nothing positive in it. You are out of line for accusing Hibby76 of anything. Are you so sure that wasnt me?     Beign from Colorado, Rehabinator could give "right on the money" type of response!

    Because of the growing world's population, fresh water is expected to become increasingly valuable commodity and just like oil, subject to major international treaty and heated discussions. Because of the importance Colorado have in US water supply chain and because of the amount of the water this Mountainous state brings to the other states, some specific legislation were necessary to regulate the field or quiet complex set of right.

    When and IF one may cash on the rights kept underneath one or more SFR's (providing such rights could be legally kept and are existing at the time of the sell) I do not know. --- Never the less, investing in evian stock may be the good start for one who truly want to appreciate the value of water, philosophy. For now on, I am restricting myself to buying of the shelf type of bottleneck investment, which often ends up going down the toilet the very same day. Bed investment? With it's unique balance of minerals and trace minerals it poses, I do not think so for now!

    If we do not adopt this rule, which is fairly common on all forums, we'll soon have no member willing to start the topic. The beauty of the system is in uniqueness of the member's thoughts and their opinions on the given subject, rather then their opinion about opinion of other's, which in hybby's case yestarday sounded like this: "You my friend have no idea....". In my book wheeler that's argumentative and based on what I've could see, some guys here do that more often then omega. In fact, I noticed his humorous, witty and sarcastic responses, but that's probably how he writes and I didn't see his post where he came and attacked anyone without being attacked.

    But that's him and because you believe that you might be doing better while allowing yourself the right to admonish me for my believes, I felt that since I like to keep my comments factual, it would be unfair for me to respond without first reading some of your recent posts. What I noticed thou is that your posts almost regularly follow omega's. Can you do tell us why is that? Are you a man on a secret (cleaning) mission to elbow his way to a moderator's desk or ... why do you do that?

    Most of your posts Wheeler I've seen here had nothing to do with the subject of any given discussion but you rather critique what others had to say, contributing nothing to the educational filed. if you do the same you'll maybe understand what you need to change in your house first before you start cleaning after others. This topic here is the perfect example of what you do, but if moderators and other members have no problem with that, you are free to follow and post dots, comas or just any few words you can think off. since all posts counts on the most active list.

    Oh, and you comment about blank posts for the top ten list...I am not even in the top 20. if you are reffering to fact that a few posts are blank, there is no way to delete a reply if it posted twice, most likely my error, so I delete one to make the tread shorter for easier reading as a courtesy.

    I think the water right Idea is a good one if you have the raw land to develop. it seems like it would be a hard sell, but if you could pull it off it would be profitable.

    I don't know where this thread is going based on all the above stuff.

    But I just wanted to add that where I am from water rights investing is for BIG players with very DEEP pockets. I would consider it pretty much akin to land speculation investing. I say that because it has more to do with being able to buy something that no one else considers valueable at this time such as land way out in the booneys and being able to hold it for 20 years in the hopes development will reach it or some event will suddenly affect the value of the land so you can make a profit.

    The majority of people who have gotten rich off of water rights out here are ranchers. They bought their land to ranch some over 50 years ago and only due to the water issues of the past 15 years, the land is now only valuable because of the water rights. A lot of ranchers and farmers here in Colorado look at their water rights as their exit plan or retirement plan out of farming and ranching.

    But for someone to speculate in water rights you have to realize that it could take up to 15 years for you to actually be able to sell the rights, since a town or city is going to be the buyer and you are talking about passing bonds through the voters, fights in court for many years over down stream rights that may be affected, fights in the courts over small towns arguing that if the water rights to the land around them are sold up stream to a big city that their town will die since the land around them will never be able to be farmed or ranched again due to no water ever being available again. It will go on and on.

    About a year ago I heard of a guy who made his living buying and selling water rights. Flips, so to speak. Buy low, sell high, subdivide, etc. I thought it was strange then. Now I wish I would have taken him out to lunch and picked his brain.
