Is This Ethic

I made an offer on a listed rental building a couple months back. I made it thru the sellers agent. It was a fair offer, listed for $115,000 and I offered $105,000. They didnt take it and thats as I high as I can go with traditional financing. The listing it going to expire soon. Would it be wrong of me to send a letter to the owners asking if they still wanted to sell when their listing expired? Then I could shoot for a lease option. I could wait til it actually expired but if they dont know I am interested they might just list again with someone else. I like the agent and dont want to offend him in any way.

    Absolutely not unethical....

    But the seller should carefully read their listing agreement concerning commission due if a buyer is introduced to the property by the listing agent.

    Some listing agency agreements extend the time period for an introduced buyer past the expiration date.
