In Pre-foreclosure and My Property is up for sale

Hi, this is my first visit. My question is, my house is in pre-foreclosure and I listed it with a real estate agent to try to sell it fast. I told the mortgage company that I listed it for sale and they said I still have to make regular payments or they can still foreclose. Is this true? I was told as long as I have it listed with an agent they can't foreclose. What is true? I need help. Just wanting to sell and get out of this house, we were lied to because the house was in worse shape than listed or that could be seen. The previous seller signed a declaration that the house was dry to the best of their knowledge and that there hadn't been any water while they lived here. Within one year we had alot of water, then it just keeps coming everytime it rains. When we put this house up for sale we had to sign something that said we knew there was some water present or that occurs. How did the previous seller get to lie and say no water problems when we bought from them?     yes the bank can foreclose even if your house is for sale. think of it this way your house is worth $100,000 and you list it for $200,000 how long do you think the bak going to wait for payments but yes they may work with you some but they will still want some type of money comeing in. as far as the other if you can prove the last sellers new of these problems you would have a case.

    So sorry you are in forcl. But do not feel bad so are a lot of others. Check your broker to be sure you are at market. Then roll up the pants and find out why the water loves your house. Make a plan of correction. Where is your house? If in Calif. please call Gov. Davis he really needs to get additional water on line. Then call me if unsatisfied with your broker I will check your situation to the fullest and advise which way to go. Yes it is true there generaly is a way to go. Lufos

    Hi, just got your message and it sounds really good, but is it something that won't catch up with us later? We really need our credit cleaned up, mine more than his, but both of us could use the help. We just lost a contract on a house we wanted because of a contingency on ours. We are waiting on ours to sell and for our credit to pass so we can move on a house and hopefully not with interest out of this world. Those new low interest rates sound really good, but I don't look for us to get one. Let me know what you do and how you can help and I will talk to my husband and watch for your reply.
