*important Issue* For All Mobile Home Owners
does anyone have knowledge of the effect on a mobile home if the land it is sitting on is sold at a delinquent tax sale..i live in tennessee and have yet to find anyone that can anwser this question. it is not a question of whether the trailor is attached to the land but instead is a question of whether the mobile home (being assessed as an improvement on the property in the tax assessor's office) goes with the property at the tax sale. as a n investor this issue comes up all the time, i go and do research on the property advetised and see that it contains a mobile home and land but after the redemption period how do you obtain a certificate of title to the mobile home? if the lein holder was notified how do you get them to release the lein if they refuse? i have been to court on this issue and am interested to here from anyone who has an opinion. it seems to me that the mobile home manufactures have an influence in legislature and have made the law so unclear that it is up in the air..please respond
The land is sold in a tax sale. The period of redemption passes and you now have title. You would also like to own the mobile home that is sitting on it. Does the mobile home owner have a lease? A rental agreement? An enforceable handshake agreement. (Verbal lease for 12 months or less). In the use permit for the land is it zoned as a trailer park, mobile home park.
Answer these questions and prior to court decision review your options. Original 13 colonies you lose. But once again why are you talking to me. Go talk to the mobile home owner. Negotiate. Besides I do not suggest you just throw him out. People get very angry when you attack their homes. Better to make a friend especialy if he is sitting on the front porch with a shot gun in his lap and a full quid of chewing tobacco. My experience is all bad.
