I Suspect Reason For Moisture Who Should Pay?
While rehabing this condo my brother who did much of the work installed the DW. The connection leaked only to be discovered by me one day later. All of the newly installed wood floor needed to be replaced and the water pooled under the floor/ceiling of underground garage. A hole was punched in ceiling and water was drained(poured) out. Fans were brought in and everything was dry before floor was replaced. The ceiling was left opened to dry for several weeks. My question is if I had hired an GC and later had a mold issue that was contributed to thier fault what would be my recourse? Sue? What?
You would contact their general liability carrier and file a claim.
This is why I constantly preach about having the necessary insurance to protect against incidences such as this.
Many in rehabbing often sub out work to handymen, family, friends and relatives........when things go wrong then you have a problem.
The insurance company would send a rep out to see if they are liable.........if so, then you get a check............if not then your recourse would be to sue the appropriate tradesmen or GC if the contract was with him.
In an instnace like this, I seriously doubt there is going to be a mold problem. This is just a matter of replacing removing the damaged material, let air out and replace those items damaged.
