How do I find filings on pre-foreclosures?
I went to the Macomb County Building in Michigan today and I was trying to get a list of pre-foreclosure filings. I was directed to the recording of deeds office and the lady there told me that there was no way for me to get a listing of pre-foreclosures, that they do not have a list like this. She told me I would have to pay $.25 for each person listed in the recording of deeds and that it really wouldn't even help me to find what I am looking for. All I want is to have a list of all pre-foreclosures in the Macomb County area and NO one seems to know what I am talking about. Can anyone help me out?
The formal term is Notice of Defaults or Lis Pendens. They didn't know what you were talking about because Investors invest in pre-foreclosures by finding Lis Pendens or NODs.

Don't get discouraged go back to the Register of Deeds and you will need to do a document search on the following:
LP - LIS PENDENS
LP1 - LIS PENDENS (LIEN)
NOT - NOTICE
NTS - NOTICE OF TAX SALE

Foreclosure laws and customs vary from State to State, and sometimes from County to County. In Michigan, a non judicial State, if the mortgage document contains the Power of Sale language, it may be foreclosed simply by publishing a notice in a newspaper (foreclosure by advertisement) and a subsequent posting on the subject property... with no formal recording of a "Notice of Default" or a "Lis Pendens" which is why the clerks didn't know what you were speaking about.
If there is to be a court action, it's likely to be following the foreclosure sale, and for the pursuit of a deficiency judgment. That paperwork will be filed in a District Court, or a Circuit Court, depending upon the amount of the deficiency. You should be advised that there may be up to a 6 month ROR. You may wish to try to purchase the ROR (for a nominal amount)
and attempt a short sale.
