How Can A Seller Not Have Their Deed?
speaking to a seller who "cant find" any of the closing docs she was given when she bought the home 10 years ago.
Should i be hesitant to do a deal with her or can i get these docs from the courthouse or somewhere else?
I havent even seen her deed.

Take the property address and go down to the county courthouse where deeds are filed and search for that deed, for the transfer to the current owner from the previous owner.
I am sure you could print that out so you at least have a copy, but make sure a deed was filed on record! Also, if you cannot find a deed in their name, get in touch with their attorney. Maybe they never filed it, or maybe the owner never filed it.

If the seller had the deed,what would be your next step? why don't you get the property under contract first and let sellers attorney worry about the www.title.they should provide you with a general warranty deed.

The deed is a worthless peice of paper, once it is recorded. You are thinking that the deed is like a car title. It is not. I can think of no reason why an owner could not throw away their deed after it is recorded.
Just have a preliminary title search performed to find out who is "the owner".

What are you afraid she "stole" the house or something?
