HELP! Manufactured Home Park Problem!

I have Leased Optioned a Manufactured home in Michigan but the Lot rent office says my tenant has to move because lot rent procedures were not followed and they need to see a mortgage!! Is there anything I can do in this situation? Any kind of assistance would be great, otherwise my client is out in 30 days.     Your paragraph is confusing.

    Are you the owner of the manufactured home in the park?

    You mention "my tenant has to move" ... and "They say they [the] owner knew about the procedure." They meaning the "rent office" [park management] ?

    "Owner" meaning [you] or who?

    Most mobile home parks have a sign on the park's property (entrance, park office, or at each mobile home for sale) that states "Do not buy a mobile home before contacting park mangement.".

    All park residents must be park approved and also sign the park's lease and park rules and part of living in the park.

    Must park require the owner of the mobile home to live in the mobile home.

    Rent to own, lease options and similar deals are not allowed in parks by management and park owners.

    In your case ... maybe a varied type of "seller financing" contract would be the way to go.

    You've got to solve a couple of problems:

    First, unless your buyer has made formal application to the MHP, and they've checked him out to their satisfaction, and approved him...he has NO right to live there.

    So your first step is to have your buyer formally apply to the MHP to be their tenant.

    Then, if he's accepted, you & he just modify your agreement to a contract to sell the MH and he buys it from you on a contract...then he can show he's got the registered title, and you've got the legal title...just like a car loan where the bank or dealer keeps the legal title and the buyer gets the registered title.

    Now, if the MHP doesn't accept him, you & he should unwrap your deal and sell to somebody else who FIRST passes the MHP screening process.
