From Bk13 To Bk7
If someone is currently in bk13 and wishes to sell the house, it is my understanding that they must first get the court to release the house from the bk. (correct so far?) If the sale does not work for them at that point, have they lost the ability to switch to bk7 with the house included?
I know someone in this situation currently, and she can't afford the bk13 payments. She would like to find a smaller place or appartment and sell the house if possible, but there are repairs needed, and little or no equity in the current house. She has other reasons for wanting to end the bk13 as soon as possible too. I'm just trying to make sure she doesn't end up pulling the house out and ending up with a foreclosure if she can't find a buyer soon enough, because there are a number of back payments due which is why she did the ch13.
