Need A Local Attorney...nj..need More Time!!
we are supposed to be out of the house on july 28,2002 after a writ of possesion but with 3 children we just haven't been able to find a place in only 30 days. the new owner is claiming ownership since april when the sherriff sale was but they had forgotten about the property until they were notified by the sherriffs dept that they had to pay for it, the title wasn't issued until june. we are due a surplus of over 100,000 from the sale...had they paid when they were supposed to we would be much further into the process. we just need some more time to find a place to live without being put out into the streets, my youngest child is only 1 and has asthma so we are desperate. the new owner is also evicting our tenants, on the notice it states that they are evicting for non payment of rent (which they increased from 1350 to 1600)from april, can they do that when they didn't technically own the own and they never even came here to talk to anyone...we don't even have a contact number to reach them. my husband has been the one maintaining the property even up until now...no one has been here to even look at the house let alone tend to anything that needs to be done like cut the grass...we do that. is there a way to get some more time, we don't want to stay anymore then we have to but we also don't want to be out on the streets...PLEASE HELP!!
To evict a tenant for non payment requires a court order.... so the new owners may either be bluffing, or they have taken steps to secure the court order.
Since they pursued the writ of possession... my guess is that they have conducted themselves properly.
If and when the Sheriff's agents arrive to physically evict you and your belongings from the premises.... best to take the children to another location. You don't want them to see that. It's ugly.
You've had more than a year to prepare for this day.
Call social services... tell them that you face an eviction, and ask for temporary shelter.
sounds like desperate times for you. i know i've been there. the reason i am telling you this is so that you will know i have been in your position even worse. my wife was dying of cancer the med. bills and high mortage on our home i could no longer keep up. i filed b/k i thought they were going to put me and my bedridden wife out on the street. you are right they most likely don't care. the pressure was over powering. before the b/k i tried to reason with the creditors i told them i wanted to pay my bills i only needed an extension or temp. lowering of my bills at least until my wife passed. they laughed in my face. luckily, for the creditors, she died before they put us out. the reality is with the july writ you will have to move they want you out . have you looked at an temp. apt. until you get things cleared. the sooner you leave the sooner you have it behind you and then you have a chance to start again. ggod luck......kenmax
