How To Find Leins Or Encumbrances Against Prop?
should i be able to find this out at my local county recorders office while i do a title/prop search, or will i have to go to the courthouse or tax asserors office? i.e. tax leins, or any leins for that matter. thanks Jeb.
The county recorder's office is a good place to start.
will they come up when i search for the title? are all leins recorded against the title? i have heard of 200,000 medical leins not showing up when someone did a title search, how can i protect myself incase i buy a prop and something like this comes up. maybe a clause in the P/S contract that states "contract is void for all leins/encumbrances" but will this protect me after i have recorded the deed. thanks
I use the title company that habdles all of my closings - normally they charge $75; but they save me 50% for an 'info' only copy.
You check the county recorders office for liens attached to a property and the clerk of courts office for judgments attached to individuals.
You should check with an attorney to find out your states laws regarding judgments attaching to real property.
