HOA Forclosure Redemption
I recently purchased a home in Houston TX that was sold due to an HOA forclosure. There is no homestead, so the previous owners only have a 180 day redemption period. They have contacted an attourney and he has contacted me. The previous owners are going to redeem the property in a week. I believe I am due rent for the time that I owned the property since they never moved out. Their attourney is telling me that they do not have to pay rent. What is the right answer. Should I receive rent or not?
Was the HOA foreclosure subject to a superior lien? If so, did you take over the payments? If so, make sure you get those payments included in the redemption.
