Fairbanks Capital Ordered To Settle In Civil Suit
I noticed the other day in USA TODAY that Fairbanks Capital was busted by Hud and the FTC for their illegal activities. I was purchasing a home from a couple that was forced out through foreclosure by this company. And personally experience their discrimination tactics as well.
Question is... the previous owners I was buying from (I was buying through Installment contract agreement) need to file their claim by April 09, 2004. But can we also file suit for illegal forclosure and eviction? The couple was only one payment behind when they started foreclosure, but when you subtract out the illegal fees they were hit with they were not behind at all. The bank took the property back in court for almost $20,K less than what they said they were to collect, and sold it for about $15,K less than that what they got it for. Are there any real estate atty's that can suggest where I can start in looking to file / present a case?
