Florida Tax Deeds

I emailed my local clerk of courts and asked about tax deeds and was told once you buy a tax deed the property is yours. Anyone know if here in Florida if liens are satisfied from the tax deed sale or if they continue on the property with the new owner??? :-?

Be careful there is a difference between tax liens or certificates and tax deeds. You can buy the tax lien or the actual property at the foreclosure of the tax lien.

Hi all you pro investors, I have a question about the Florida tax lien and tax deed auction. Do you have to be present to buy at the tax lien auction ? or do they hold the bidding process on line. If not are there any states, or counties that hold on line auction.?[ Edited by homee on Date 08/07/2004 ]

When you purchase via a tax deed in Florida, the clerk of the court issues a "Tax Deed." This deed is a transfer of any rights that the clerk may have to the property. It is only slightly better than a "Quit Claim Deed." It does not guarantee an insurable title. Nor does it guarantee that there are no liens.

All governmental liens survive a tax sale and stay with the property. They will need to eventually be resolved if there was not enough overbid money generated at the sale to pay them off.. In order for you to sell the property with an insurable title, you must quiet the title. This can be done with a "Quiet Title" lawsuite. As an alternative, the title will automatically quiet four years after the date purchased at the sale, as long as there have been no claims against the property by previous owners. Hope this helps.[ Edited by GeneralSnafu on Date 08/10/2004 ]
