Florida Rental Agreement Disclosure

Hello,

I have a brand bnew townhome ready to be rented. I was wondering if I still have to put anything regarding Lead-based paint and Radon Gas disclosure in the Rental Agreement ?

    i do not have it handy, but I think that mine references building built prior to 1979. but i always hand it out along with "protect your family from lead in the home"

    Only for properties built prior to say, 1980. If it was built sometime in the 70's then there is a chance that some lead-based paint may have been used on the property.

    so if my home is brand new, do I need to put anything in the Rental Agreement regarding Lead-based paint and Radon Gas disclosure???

    Don't worry about the lead based paint there is NO way a new home has lead based paint. I think it would be a good idea to say radon gas may be present. I am not sure if the radon gas is required in rentals. I am a agent but I don't do rentals. When someone buys a home from a florida agent radon gas is disclosed.

    Technically, you must provide a lead paint disclosure if the house was built prior to 1978.

    The townhouse is new (which is a relative term, but I assume its less than 5 years old). So in that case, you would not need a lead paint disclosure for renting or selling.

    For Radon Gas, you will have to check your state laws on that one.

    I do not mention Radon Gas in my lease, but when I sell, I have a clause that says something like,

    "Radon Gas is known to exist in homes in IL.... It is not known if this home has it, but you're welcome to have an inspection done at your expense...."

    Since most homes in Florida do not have basements, I do not know that it would be an issue for you. My understanding is that Radon Gas is more of a problem in homes with basements.
