FLA Disclosure Law

I recently purchased a single Family home in FLA as part of a 1031 exchange. The seller of the property failed to disclose facts that materially affect the value of the property. The seller states he was under no obligation to disclose because by purchasing the home as a tax deferred exchange I designated the property commercial. FLA commercial real estate laws state there is no obligation to disclose. This property and my relinquished property both have been filed with the IRS as Residential Rental Property. Is the seller correct, can a 1031 exchange turn what would otherwise be considered residential into commercial in the eyes of the FLA courts. confused
